The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302, 120B/34 of the Indian Penal Code.
The prosecution case is that on 25.07.2015 at 4.00 P.M. Md. Abulaish called the husband of the informant through mobile, but he did not return. Subsequently, dead body was recovered, leading to registration of First Information Report against accused persons. During investigation it transpired that petitioner also conspired in the said incident since he is full brother of Md. Abulaish.
It is submitted by the learned counsel for the petitioner that only on suspicion accusation has been
Patna High Court Cr.Misc. No.18156 of 2016 (2) dt.27-04-2017 levelled. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the fact that petitioner was not named in the First Information Report and only on suspicion accusation has been raised against him, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Parsauni P.S. Case No. 81 of 2015, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
