Petitioner seeks bail in a case registered under Section 20 (b) of NDPS Act.

Petitioner, having clean antecedent, submits that he was merely a co-passenger of the vehicle and was travelling after paying fare and he has no concern with the recovery of Ganja from the vehicle in question. He submits that he is in custody since 01.02.2017 and that he has falsely been implicated in this case as the seizure is also not in accordance with the procedure. Considering his aforesaid submissions, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand)

Patna High Court Cr.Misc. No.31681 of 2017 (7) dt.28-02-2018 2/2 with two sureties of the like amount each to the satisfaction of Additional Sessions Judge I -cum- Special Judge, NDPS Act, Nawada in Special Case No 1 of 2017 arising out of Prosecution Report No 155 dated 01.02.2017 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
