JUSTICE SANJAY PRIYA ORAL ORDER 19-07-2017 Heard learned counsel for the petitioners and the State. The petitioner seeks bail in Kishanpur P.S. Case No. 53 of 2017 instituted for the offence under Sections-302, 201/34 of the Indian Penal Code.
The petitioner is in custody since 06-04-2017. As per written report filed by daughter of the petitioner, the deceased Poonam Devi, mother of the informant was assaulted by this petitioner and other accused persons, causing serious injury to her and thereafter, she was taken to somewhere on the pressure of the villagers and location was not disclosed by the accused persons.
Counsel for the petitioner has submitted that on 22-032016, fardbyan of Arvind Kumar Yadav, nephew of the deceased
Patna High Court Cr.Misc. No.29787 of 2017 (3) dt.19-07-2017 was recorded in the PMCH where the deceased was getting treatment and he has stated that she (since deceased) sustained injury in road accident and died in PMCH in course of treatment. The postmortem report has been filed as Annexure-3 wherein the doctor has stated the cause of death as hard and blunt object on account of road traffic accident as suspected by the I.O. Learned APP submitted that the police after investigation, submitted charge sheet u/S 304 of the Indian Penal Code against the petitioner.
In such circumstances, prayer for bail is allowed and it is ordered that the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kishanpur P.S. Case No. 53 of 2017 to the satisfaction of learned Chief Judicial Magistrate, Supaul subject to condition that both the bailors should be relatives of the petitioner. (Sanjay Priya, J) A.K.V./- U T
