Petitioner apprehends his arrest in a case registered for the offence punishable under Section 363, 366(A), 34 of the Indian Penal Code.
As per the prosecution case, this petitioner along with other accused persons kidnapped the minor daughter of the informant.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. The victim in her statement u/s 164 of the Cr. P. C. denied the prosecution case and has stated that she was in love with the petitioner and no one has kidnapped her. The victim stated her age to be 19 years. Petitioner has got clean antecedent. Learned counsel appearing for the State opposes the
Patna High Court CR. MISC. No.938 of 2022(3) dt.01-09-2022 2/2 prayer for anticipatory bail.
Considering the facts of the case, clean antecedent of the petitioner and the statement of victim recorded u/s 164 of the Cr. P. C., let the petitioner, above named, in the event of his arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate (West), Muzaffarpur in connection with Kanti PS case No. 556/ 2021, subject to conditions laid down u/s 438(2) of the Cr.
