The petitioner apprehends arrest in connection with Shastri Nagar P.S. Case No. 386 of 2021 registered under Sections 30(a), 32, 37(b)(c) and 56 of the Bihar Prohibition and Excise Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to misconception of fact and at the instance of the authorities for illegal gratification. Further he submits that the said R.P. Grand OYO Hotel is owned by the father of the petitioner. Only on the confessional statement of co-accused, petitioner's name has been transpired in the instant
Patna High Court CR. MISC. No.947 of 2022(2) dt.06-05-2022 2/2 case. Petitioner has no concern with the seized materials. It is also submitted that petitioner has no criminal antecedent. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond o the satisfaction of the Special Judge, Excise Act, Patna in connection with Shastri Nagar P.S. Case No. 386 of 2021, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
