2. The petitioner apprehends his arrest in a case registered for the offence under Sections 223, 126(2), 115(2), 352, 351(2), 351(3), 303(2), 329(3), 111(6), 111(7), 338, 336(3), 340(2) & 3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. As per prosecution case, on 28.05.2025, all the F.I.R. named accused persons including this petitioner abused and assaulted Sanjeev Kumar, who was care-taker of the property of the informant, and thereafter, ousted him from the house in order to grab the land and house of informant, which is in violation of the status quo order, passed by Hon'ble High Court, Patna, in S.A. No. 90 of 2022.
4. Learned counsel for the petitioner submits that the land in question was purchased in the name of Govind Ram Bajan but after partition by Arbitrator, Ajay Kumar Bajaj
Patna High Court CR. MISC. No.62145 of 2025(2) dt.11-09-2025 2/3 (brother of petitioner) came in possession, even then Govind Ram Bajaj sold 4 Bigha 15 Dhur of land out of total 5 Bigha 12 Katha 7 Dhur through registered sale-deed dated 26.12.2012. He further submits that the original land owner namely Ajay Kumar Bajaj was in need of money and as such, he decided to sell out the land in question, for which, he entered into an agreement to sale with petitioner on 01.11.2024 and thereafter, this petitioner, on the basis of sale agreement, executed an agreement with Amit Kumar on 22.11.2024 with respect to land in question and there was hut over the said land, in which there was some articles, which were looted by some miscreants, as a result of which, Amit Kumar had lodged an F.I.R., vide Chitragupta Nagar P.S. Case No.
58 of 2025 (Annexure - P/4). The present F.I.R. has been lodged as counter blast of Chitragupta Nagar P.S. Case No. 58 of 2025. He further submits that present F.I.R. has been lodged after a delay of 9 days and there is no plausible explanation of delay. There is general and omnibus allegation.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the delay in lodging the F.I.R., general & omnibus allegation and the fact that there is case & counter case, the prayer for anticipatory bail of petitioner is allowed.

Accordingly, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Chitragupta Nagar P.S. Case No. 60 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023. (Prabhat Kumar Singh, J) anay U T
