Mr.Sharda Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-12-2023 Heard learned counsel for the petitioners and learned APP for the State.

The petitioners are languishing in custody in a case registered for the offences punishable under Section 394 of the Indian Penal Code.

It is alleged that cash of Rs. 25,000/- of the informant and other bundle of Rs. 5,000/- was robbed by three unknown motorcycle borne criminals.

It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. The petitioners are not named in the F.I.R nor they were apprehended from

Patna High Court CR. MISC. No.65286 of 2023(3) dt.20-12-2023 2/2 the spot. The petitioners were caught by the villagers with a bag which was alleged to be snatched from the informant. The petitioners have still not been put on T.I.P. The petitioners are students and languishing in custody since 07.07.2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail after framing of charge, if the charge has still not been framed and on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 737 of 2023.
