JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Bela P.S. Case No. 123 of 2019 registered for the offences punishable under Sections 147, 149, 341, 323, 332, 353, 504 of the Indian Penal Code and Sections 37(b), 37(c) of Bihar Prohibition and Excise Act.

Allegation as per FIR is that police on information that accused persons were creating nuisance in drunken condition and police reach there and caught hold of one Raj Mangal Singh and petitioner and others started pelting stones and tried to set free the apprehended person from the police custody.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he has no criminal antecedent.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.
