JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 395, 397 of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleges that four unknown criminals entered into the house of the informant and assaulted his wife by butt of the pistol and looted her gold chain, gold bangle and ornaments worth Rs. 6-7 lakhs along with mobile.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

Nothing has been recovered from the conscious possession of the petitioner. The name of the petitioner sprang up on the confessional statement of co-accused Shahbaj Ali @ Siddiqui @ Rikki Khan and except confession, nothing has come against the petitioner. The petitioner is languishing in custody since 25.08.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga in connection with Laheriasarai P.S. Case No. 263 of 2019.
