2. The petitioner seeks bail in a case registered for the offences punishable under Sections 25(1-b)a/26/35 of the Arms Act and 3⁄4 Explosive Substances Act.

3. As per the prosecution case, informant along with other police personnel had gone to investigate a case. The accused persons namely Muneshwar Kewat and Jakir Hussain confessed their guilt about their involvement in the crime and told the police about the place where they had hidden the arms. On this, the police went at Damaipur Mauza and recovered one country made pistol and explosive items from a field. One person Md. Akil was also apprehended and country made pistols and magazine were recovered from his physical possession.

4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. His name transpired during investigation on the basis of confessional statement of other apprehended co-accused. No incriminating articles have been recovered from the conscious possession of the petitioner. Petitioner is in custody since 17.06.2025. Charge-sheet has been submitted.

5. Learned A.P.P. for the State vehemently opposed the prayer for bail.

6. Considering the aforesaid facts and circumstances as well as period of custody, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Katihar in connection Azamnagar P.S. Case No. 101 of 2024.
