JUSTICE SANDEEP KUMAR ORAL ORDER 04-03-2023 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner seeks regular bail in connection with Hajipur Town P.S. Case No. 369 of 2022 registered for the offence punishable under Sections 25(1-b)A, 26 and 35 of the Arms Act, 1959.

It has been submitted by learned counsel for the petitioner that similarly situated co-accused has been granted bail by a co-ordinate Bench of this Court in Cr. Miscellaneous No. 41184 of 2022 vide order dated 15.11.2022. From the perusal of the order dated 15.11.2022 passed in Cr. Miscellaneous No. 41184 of 2022, it appears that the petitioner of that case has clean antecedent whereas the present petitioner has four criminal antecedent.

Patna High Court CR. MISC. No.72835 of 2022(2) dt.04-03-2023 2/2 Considering the aforesaid facts, I am not inclined to grant bail to the petitioner. Accordingly, this application for regular bail is dismissed.

The District Judge, Vaishali at Hajipur is directed to transfer all the cases pending against the present petitioner in one court having jurisdiction over the cases and get the trial of the aforesaid cases expedited.

Let a copy of this order be communicated to the District Judge, Vaishali at Hajipur through FAX forthwith for its compliance.
