JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 04-06-2015 Heard learned counsel for the petitioner and the State. The petitioner, who has been declared as a Juvenile, has been made an accused in Gaighat P.S. case no. 364 of 2014 under Sections 394 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner has been illegally remanded in the instant case from Gaighat P.S. Case No. 362 of 2014. He further submits that the petitioner is not named in the F.I.R. He submits that the petitioner has already been granted bail in Gaighat P.S. case no. 362 of 2014. Considering the fact that the petitioner is a juvenile and has remained in custody since 30.03.2015, the petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount

Patna High Court CR. REV. No.415 of 2015 (2) dt.04-06-2015 2 / 2 each to the satisfaction of Principal Magistrate, Juvenile Justice Board, Muzaffarpur in connection with Gaighat P.S. Case No. 364 of 2014 with the following conditions:

(i) The parents of the boy (petitioner) would file an affidavit before the court below that they will take proper care of the child.

(ii) One of the parents would at least accompany the boy (petitioner) during his proceedings before the court below. This application stands disposed of.
