JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 01-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Sirdala P.S. Case No. 264 of 2016 registered under Sections 147, 148, 149, 341, 323, 379, 427, 436, 504, 506 and 387 of the Indian Penal Code and Section 27 of the Arms Act and Sections 15, 18, 19 and 20 of the U.A.P. Act.

The petitioner along with other accused persons are said to be extremists and have burnt the vehicles and machines engaged in construction work of bridge and resorted firing for non-payment of levy for carrying out construction work of the bridge of the Railway Station Kharaundh.

It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and he has committed no

Nothing incriminating article has been recovered from the conscious physical possession of the petitioner. There is no specific allegation against the petitioner. The petitioner has been languishing in custody since 07.05.2017. Co-accused, namely, Jawahar Yadav and Karu Yadav have been enlarged on bail by a co-ordinate Bench of this Court vide order dated 30.03.2017 passed in Cr. Misc. No. 13323 of 2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-V, Nawada in connection with Sirdala P.S. Case No. 264 of 2016.
