JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 354, 380, 497, 498A and 504/34 of the Indian Penal Code. The prosecution case is that the informant Sita Devi used to make protest against extra marital relationship of her husband with co-accused Muniya Devi and on such protest, the petitioners being the brothers of Muniya Devi assaulted the informant when petitioner no.1 tried to outrage the modesty of the informant and snatched the gold chain of the informant. It is submitted by learned counsel for the petitioner that even assuming the accusation, none of the offences as alleged is made out against the petitioners and thrust of accusation is against

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned JM, 1st Class, Katihar in connection with Muffasil P.S. Case No. 30 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
