JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2017 The petitioner seeks regular bail in connection with Araria P.S. Case No. 270 of 2017, registered for offences punishable under Section 25(1-b)(a)/26 of the Arms Act. Allegation against the petitioner is of recovery of one pistol along with four live cartridges.

It has been submitted on behalf of the petitioner that he is only a mechanic and he has falsely been implicated in this case. Further he has clean antecedent and has been in judicial custody for last three months.

Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case and the nature of allegation, I am not inclined to release the petitioner on bail, at least, at this stage, his

Patna High Court Cr.Misc. No.30238 of 2017 (3) dt.24-07-2017 2/2 application for regular bail is, accordingly, rejected. However, the petitioner may renew his prayer for bail in the court below itself, after framing of charge in this case or after completion of further three months in judicial custody, whichever, is earlier.
