Heard the learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest for the offences alleged under Sections 147, 148, 186, 188, 323, 353, 337, 504 and 506 of the Indian Penal Code, registered in connection with Khirimor P.S.Case No. 94 of 2021. As per allegation, the accused persons made a demand for recounting of votes of Mukhiya election. Recounting was done, but they were not satisfied with the result and they created chaos, misbehaved with the persons, who were engaged in counting of votes. The petitioner was the counting agent of Savita Kumari (a candidate in Mukhiya election), and he was amongst the persons, who created chaos. The learned counsel for the petitioner has
Patna High Court CR. MISC. No.73268 of 2022(2) dt.30-01-2023 2/2 submitted that he is innocent and has falsely been implicated in this case. He is a person of clean antecedent. Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-III, Danapur, Patna in connection with Khirimor P.S.Case No. 94 of 2021, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
