JUSTICE DINESH KUMAR SINGH ORAL ORDER 09-05-2016 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323,307 and 506/34 of the Indian Penal Code.

The prosecution case is that on 11.2.2016 the petitioners assaulted the son of the informant in the evening. The informant went to make protest then on the next day also they assaulted the son of the informant indiscriminately. When the second son of the informant namely Sikandar Choudhary went to rescue then he was also assaulted.

It is submitted by the learned counsel for the petitioners that for petty dispute the accusation has been levelled and the

Patna High Court Cr.Misc. No.20272 of 2016 (2) dt.09-05-2016 2/2 injuries of both the injured have been found to be simple. There is counter version of the occurrence. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Obra P.S. Case No.24 of 2016 subject to the conditions as laid down under Section 438(2) Cr.P.C.
