2. The petitioner seeks regular bail in connection with Chhatauni P.S. Case No. 155 of 2017 registered for the offence under Sections 366, 120(B) of the Indian Penal Code.

3. As per the prosecution case, the petitioner is accused of kidnapping the minor daughter of the informant. From the materials available on record, it appears that the victim girl was in a relationship with one Ajit Kumar, who was granted privilege of bail by a Co-ordinate Bench of this Court vide order dated 21.09.2017 passed in Cr. Misc. No.46692 of 2017.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has not committed any offence. The petitioner is in custody since 30.05.2025.

5. Learned A.P.P. appearing for the State has

Patna High Court CR. MISC. No.63451 of 2025(2) dt.17-09-2025 2/2 vehemently opposed the prayer for bail.

6. Considering the facts and circumstances of the case as well as the fact that co-accused, namely, Ajit Kumar has already been granted privilege of bail by a Co-ordinate Bench of this Court, this application for regular bail is allowed.

Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District & Additional Sessions Judge, Exclusive Special Judge (Rape and POCSO Cases), East Champaran, Motihari/concerned Court below in connection with Chhatauni P.S. Case No. 155 of 2017 subject to condition that:- (i) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and non-cooperation in the trial shall result in cancellation of the bail bonds of the petitioner.
