Petitioner seeks bail in a case registered under Sections 386, 387, 379/34 of Indian Penal Code in which cognizance has been taken under Sections 395 and 412 of IPC. Learned counsel for the petitioner submits that petitioner is accused in a case relating to robbing of a Tata Sumo vehicle of the informant. It is further submitted that the name of petitioner has been dragged in the instant case on the basis of confessional statement of co-accused Mantu Mandal. Further submission is that chargesheet has been submitted and that there is no criminal antecedent prior to the instant case. It is also submitted that the said Mantu Mandal, on whose confessional

No.29863 of 2017 (2) dt.06-07-2017 2/2 statement, petitioner has been dragged in the instant case, has already been granted bail vide order dated 06.09.2016 passed in Cr Misc No 29341 of 2016. He further submits that from perusal of the said order, it is obvious that other three co-accused have also been granted bail by this Court. It is also submitted that there is no recovery of any incriminating article from the possession of the petitioner.

Considering the aforesaid facts and circumstances, prayer for bail is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bhagalpur in Sultanganj Police Station Case No 57 of 2015.
