JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 26-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Banka P.S. Case No. 108 of 2016 registered under Sections 406 and 420 of the Indian Penal Code.

It is contended by the learned counsel for the petitioner that co-accused Rajeev Kumar and Pramila Devi having identical allegation to that of the petitioner have been granted bail by different Benches of this Court vide orders dated 09.05.2016 passed in Cr. Misc. No. 18582 of 2016 and

Patna High Court Cr.Misc. No.23346 of 2016 (2) dt.26-05-2016 2 / 2 10.05.2016 passed in Cr. Misc. No. 18865 of 2016 respectively. Learned counsel for the State does not dispute the aforesaid submission made by the learned counsel for the petitioner.

Regard being had to the submissions advanced at the Bar, in the event of arrest or surrender in the court below within six weeks from today, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No. 108 of 2016 subject to the conditions as laid down under Section 438(2) Cr. P.C. (Ashwani Kumar Singh, J.) Sanjeet/- U T
