JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-09-2019 This application, for grant of anticipatory bail, arises out of Kashichak P.S. Case No. 146 of 2018, disclosing offences under Sections 147, 148, 149, 324, 307, 333, 353, 427, 504 and 506 of the Indian Penal Code.

Allegation as per F.I.R. is that petitioner and other accused persons assaulted the doctor and other patients of the hospital and also damaged the ambulance on the death of a person in the hospital.

Submission of learned counsel for the petitioner is that though, he is named in the F.I.R., no specific allegation has been attributed to the petitioner and he has no criminal antecedent Heard learned A.P.P. also.

Having heard both sides, in view of he above facts,

Patna High Court CR. MISC. No.61469 of 2019(2) dt.26-09-2019 2/2 this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -VI, Nawada, in connection with Kashichak P.S. Case No. 146 of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
