JUSTICE SANJAY PRIYA ORAL ORDER 4/ 20-09-2017 Heard learned counsel for the petitioners and learned APP for the State as well as counsel for the Informant. Petitioners apprehend their arrest in Valmikinagar P.S. Case No.27 of 2017 instituted for the offence under Section(s) 341, 323, 447, 436, 354, 427/34 Indian Penal Code. It is alleged in the written report that petitioner Nos. 2 and 3 sprinkled kerosene oil on the house of the informant and petitioner No.4 lit the fire. It is alleged that petitioner No.1 caught hold of the informant with bad intention. Case diary has been received. Place of occurrence has been described in para 4, wherein, the police has not found
Patna High Court Cr.Misc. No.31726 of 2017 (4) dt.20-09-2017 2/3 any sign of burn at the place of occurrence. The informant has not disclosed name of any article said to have been burnt on account of setting the house on fire by the accused persons. It has been submitted that the petitioners have been falsely implicated on account of land dispute. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Valmikinagar P.S. Case No.
27 of 2017, they shall be released on anticipatory bail on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, Bagaha, West Champaran, subject to the conditions as laid down under Section 438(2) Cr. P. C.
