JUSTICE SATYAVRAT VERMA ORAL ORDER 03-03-2022 Heard Mr. Ram Prawesh Kumar, learned counsel for the petitioner and Mr. Rajesh Kumar, learned APP for the State. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks bail in connection with K. Hat (Maranga) P.S. Case No. 1146 of 2021 registered under Sections 272, 273 of the Indian Penal Code read with Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is in custody since 06.12.2021, charge-sheet has been submitted and is a person with clean antecedent and allegation is of recovery of 131.400 litres of liquor from the field and the petitioner was arrested while two accused fled.

No.1130 of 2022(2) dt.03-03-2022 2/2 Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case and he he was merely passerby and the real culprits after throwing the same had fled away and the petitioner came to be implicated. Learned APP opposes the bail application.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted and is a man with clean antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.2,000/- (Rupees two thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Purnea in connection with K. Hat (Maranga) P.S. Case No. 1146 of 2021.
