JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2015 The petitioner is apprehending her arrest in connection with Lalganj P.S. Case No. 236 of 2014 for the offences instituted under sections 341/323/436/504/302/34 of the Indian Penal Code. Heard learned counsel for the petitioner and learned counsel for the State.
The prosecution story, in brief, is that all the accused persons came at the house of the informant and assaulted informant's daughter, namely, Lalita Devi and co-accused Sanjay Paswan set ablaze the house of the informant resulting Sakindra Paswan died in the house after burning.
It has been submitted on behalf of the petitioner that the main allegation is against Sanjay Paswan and there is no specific allegation against the petitioner. It is further submitted that both
Patna High Court Cr.Misc. No.27134 of 2015 (2) dt.21-07-2015 2/2 the parties are close agnates.
On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of arrest or surrender before the learned court below within a period of six weeks from today in connection with Lalganj P.S. Case No. 236 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
