JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-08-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be rice miller and is languishing in jail custody since 20.05.2015 on the accusation that he did not supply rice to the Corporation and accordingly, he embezzled amount of rupees more than one crore.
The contention on behalf of the petitioner is that even if the prosecution story assumed to be true, then also, it is a case of breach of agreement and moreover, a certificate case has already been instituted against the petitioner.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released
Patna High Court Cr.Misc. No.31731 of 2015 (2) dt.13-08-2015 2/2 on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri B.N. Prasad, Judicial Magistrate 1st Class, Saharsa in connection with Bihara P.S. Case No. 75 of 2015.
