JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 452, 341, 323, 324, 307 and 34 of the Indian Penal Code and Section 3 (1) (r) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act.

Allegation against the petitioners is that while informant and his family members were sleeping at night, petitioners entered into his house and assaulted his son and other family members and they sustained injuries.

It has been submitted on behalf of the petitioners that they are in custody since 4.2.2016. Chargesheet has been submitted in the present case. There is no allegation of tampering of evidence against the petitioners. General and omnibus allegation has been made against them.

On behalf of the State, it is submitted that petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties

Patna High Court Cr.Misc. No.20994 of 2016 (3) dt.21-07-2016 2/2 of the like amount each to the satisfaction of Sri Manoj Kumar, Judicial Magistrate, Ist Class, Araria, in connection with Bausi P.S. Case no. 7 of 2016.
