JUSTICE SUDHIR SINGH ORAL ORDER 29-07-2015 The petitioner is apprehending his arrest in connection with Saran Mahila Police Station Case No. 31 of 2013 for the offences instituted under Sections 341/323/504/506/376/34 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

Prosecution case, in short, is that petitioner Tarkeshwar Singh is well known her from last two years and he always comes at her house and he used to do intercourse with her without her consent. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. It is further submitted that the police after investigation submitted final form against the petitioner, which is Annexure-2 to the present application. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is

Patna High Court Cr.Misc. No.30079 of 2015 (2) dt.29-07-2015 2/2 directed that the petitioner shall be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Saran Mahila P.S. Case No. 31 of 2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Saran at Chapra, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
