The petitioner apprehends his arrest in Sadar P.S. Case No. 10 of 2017 instituted for the offence under Sections 420, 467, 468, 471, 120B, 506, 506/34 of the Indian Penal Code and Section 138 of N.I. Act.

There is specific allegation in the written report that this petitioner along with co-accused Arvind Kherwar took Rs.23,50,000/- from the informant for sale of land as is described in the written report which was later on found to belong to one Umesh Chandra Gupta. The petitioner and other co-accused, thereafter, did not return the money in terms of Mahadnama which was prepared at the time of entering into agreement for

Patna High Court Cr.Misc. No.29758 of 2017 (2) dt.10-07-2017 2/2 purchase of the land. They issued cheque in the name of mother of the informant on various dates which is annexed as Annexure-2. The said cheques bounced due to insufficient fund in the account. In such circumstances, keeping in view the direct and serious allegation against the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner stands rejected.
