JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 29.10.2015 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Earlier prayer for bail of the petitioner was rejected by a coordinate bench of this court and trial court has reported that out of nine prosecution witnesses, seven prosecution witnesses have already been examined and now, doctor and the Investigating officer have been left to be examined. Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Sessions Trial no. 143/2013 arising out of Madhepura (Bharrahi O.P.) P.S. Case no. 537/2012 pending in the court of Addl. Sessions Judge II, Madhepura/concerned court stands rejected.

However, the learned trial court is directed to

Patna High Court Cr.Misc. No.30401 of 2015 (3) dt.29-10-2015 conclude the trial of the petitioner within three months from the date of receipt/production of a copy of this order, failing which the petitioner shall be entitled to renew his prayer for bail before the trial court itself.
