JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-05-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-395, 397, 412 of the Indian Penal Code and under Section-4 of the Explosive Substances Act.
Petitioner is not named in the first information report but in course of investigation, the name of petitioner came in this case in confessional statement of co-accused and after that, the petitioner was arrested and it is alleged that Rs. 15,370/- was recovered from possession of wife of the petitioner. It appears that except the aforesaid materials, there appears to be nothing against the petitioner. Moreover, the petitioner was arrested on 18-07-
Patna High Court Cr.Misc. No.20917 of 2016 (2) dt.19-05-2016 2/2 2015 at Dehradun and he was remanded in the present case on 2207-2015 but uptill now, he has not been put on test identification parade.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kotwali (Adampur) P.S. Case No. 318 of 2015 corresponding to Sessions Trial No. 595 of 2015 to the satisfaction of Learned Additional District & Sessions Judge-II, Bhagalpur. (Hemant Kumar Srivastava, J) A.K.V./- U T
