The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 498A, 504/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Basic accusation is of torture for non-fulfillment of dowry demand.

It is submitted by learned counsel for the petitioner that the petitioner admits his marriage with the informant and he is ready to keep the informant as wife with dignity and honour. A statement to that effect has been made in paragraph 11 of the petition which reads as follows :- "That the petitioner is always ready to keep her the

Patna High Court Cr.Misc. No.20825 of 2016 (2) dt.10-05-2016 2/2 informant with full dignity, love and care...." It is further submitted that the petitioner has performed second marriage.

Though, the informant appeared before the learned Court below and shown some burn injuries but there is no accusation of burn injury in the First Information Report. The aforesaid facts constitute ground for consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Andhramath P.S. Case No.4/2016, pending before the learned Judicial Magistrate, 1st Class, Jhanjharpur, Madhubani.

With the above observation, this application is, accordingly, disposed off.
