The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a), 32(ii), 34(ii), 38(ii), 41(i) of Bihar Prohibition and Excise Act. 466.560 liters of foreign liquor has been recovered from the Maruti car of Sujeet Kumar and behind the house of this petitioner.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of the petitioner. Petitioner has got clean antecedent. Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs.

Patna High Court CR. MISC. No.1257 of 2022(3) dt.24-08-2022 2/2 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge cum Excise Court, Vaishali in connection with Mahua P.S. Case No. 580 of 2020, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
