The petitioner apprehends his arrest in connection with Barhara Police Station Case No.138 of 2019 registered under Sections 147, 148, 149, 341, 323, 324, 325, 307 and 302 of the Indian Penal Code.
Learned counsel for the petitioner submits that while on the basis of the fardbeyan of the informant Manoj Sao, the present case was lodged against 24 persons but the petitioner was not named therein. Later on, the statement of Saguni Sao, the brother of the deceased Faguni Sao, was recorded on 21.04.2019 at 10.45 A.M., after the death of Faguni Sao, in which he disclosed the name of nine persons including the
Patna High Court CR. MISC. No.59585 of 2019(2) dt.20-09-2019 2/2 petitioner with specific allegation against Prabhakar Bind to give iron rod blow at the head of the deceased. In fact, the petitioner being the co-villager was present near the Barat Party, but, later on, he has also been implicated in this case. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhojpur at Ara, in connection with Barhara P.S. Case No.138 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
