====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 08-12-2025 Heard learned counsel appearing on behalf of the petitioners and learned A.P.P. appearing on behalf of the State.
2. The petitioners apprehend their arrest in a case registered for offences punishable under Sections 126(2), 115(2), 109, 76, 303(2), 352, 351(2), 351(3) and 3(5) of the B.N.S., 2023.
3. As per the prosecution case, on 04.04.2025 at about 03:50 P.M., some distemper work was going on at the informant's house and due to dusting, her neighbours entered her house and started abusing her. It is alleged that Md. Akhtar inflicted a rod blow on her head, causing injury. It is further alleged that the petitioner and co-accused, Irshad, attacked her with a dagger.
4. Learned counsel for the petitioners submits that the incident arose out of a petty dispute, both sides sustained
Patna High Court CR. MISC. No.64797 of 2025(3) dt.08-12-2025 2/2 injuries, there is a case and counter-case and the injuries allegedly caused by the petitioners are simple in nature.
5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioners.
6. Considering the facts and circumstances of the case and the fact that there are general and omnibus allegations against these petitioners, the prayer for anticipatory bail is allowed.
7. Accordingly, in the event of arrest or surrender within a period of eight weeks from today, let the above-named petitioners be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Muzaffarpur, in connection with Town P.S. Case No. 169 of 2025, subject to the conditions laid down under Section 482(2) of the B.N.S.S.
