2. It transpires that prior to the present bail petition, the petitioner had moved bail petition bearing Cr. Misc. No. 25047/2022 which was rejected by this Court vide order dated 20.12.2022 and no time was stipulated to approach this Court in case of non conclusion of the trial. It further transpires that the petitioner has not approached the trial court. It is advisable for the petitioner to approach the trial court first with his fresh ground if any.

3. Accordingly, Ld. Counsel for the petitioner seeks permission to withdraw the present petition with liberty to file afresh before the trial court and if occasion arises, he may approach this Court also.

4. Permission is granted.
