ANJANA MISHRA ORAL ORDER 04-08-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with S.C./S.T. P.S. Case No. 51/2014 registered for the offences punishable under Sections 323, 504, 420, 467/a34 of the Indian Penal Code.

Learned counsel for the petitioner submits that admittedly the dispute between the parties is with regard to sale of the land of the complainant, for which a sum of Rs. 6, 40,000/- was advanced by the co-accused Laxman Singh. It is further submitted that the only allegation which has been levelled against the petitioner is that he was present at the time of occurrence, when the agreement of sale between the parties were arrived.

So far as the allegation, under the provisions of SC/ST

Patna High Court Cr.Misc. No.30172 of 2015 (2) dt.04-08-2015 2/2 Act are concerned, learned counsel for the petitioner submits that from the plain reading of the FIR, it is admitted that the incident occurred not at the public place but at Darwaza of the informant. Considering the aforementioned facts and vague nature of allegation and also because the petitioner has got no criminal antecedent, let the above named petitioner, in the event of his arrest or surrender before the Court below within a period of three weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with S.C./ST P. S. Case No. 51/2014, subject to condition as laid down under Section 438( 2) of Cr. P.C. (Anjana Mishra, J) Sudha/- U T
