The petitioners apprehend their arrest in Raniganj P.S. Case No. 87/2015, registered for the offence punishable under Sections 376 and 313 of the Indian Penal Code. The victim alleged that Md. Equbal on the pretext of marriage committed rape with her and when she became pregnant his father and brother-in-law on the pretext of marriage got her aborted.

It is submitted that police after investigation submitted final form finding the case false. Thereafter, cognizance was taken.

Md. Equbal has already granted anticipatory bail by a

Patna High Court Cr.Misc. No.20847 of 2016 (2) dt.20-05-2016 2/2 coordinate Bench of this court vide order passed in Cr. Misc. 32956/2015. Petitioners are father and brother-in-law of Md. Equbal.

Considering the facts aforesaid and the fact that petitioners are father and brother-in-law of Md. Equbal, the petitioners above-named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri S. Kumar No. II, learned Judicial Magistrate Ist Class, Araria in connection with Raniganj P.S. Case No. 87/2015, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
