JUSTICE MOHIT KUMAR SHAH ORAL ORDER 23-06-2023 The present petition has been filed seeking the following relief :- "(i) For issuance of an appropriate writ and/ or order and/ or direction commanding the respondents to include the name of the petitioner also in the panel for the regularisation of such employee pursuant to the advertisement no. 1 of Buxar Nazarat dated 02.01.2013."

At the outset, the learned counsel for the respondent- State has referred to the counter affidavit filed on behalf of respondent no. 5, more particularly paragraph no. 4 onwards, wherein it has been stated that a panel was prepared by the District Selection Committee, Buxar on 30.10.2013, which was valid upto 31.03.2014 and thereafter, its validity was extended upto 29.10.2014, on account of the elections being held in the month of April and May, 2014. It is further submitted that finally, the petitioners could not be accommodated, though their names find place in the aforesaid panel prepared by the District Selection Committee, on account of unavailability of sanctioned post and now, since the panel has already stood

Patna High Court CWJC No.23233 of 2013(2) dt.23-06-2023 3/3 expired, the present writ petition has been rendered infructuous.

In view of the aforesaid, nothing survives for consideration in the present writ petition, hence, the same stands dismissed.
