JUSTICE DINESH KUMAR SINGH ORAL ORDER 31-07-2015 Heard learned counsel for the petitioner and learned APP for the State.
Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 406 of the Indian Penal Code.
It is alleged that petitioner took Rs. 1,50,000/- from the informant. Subsequently, petitioner issued a cheque of Rs. 1,05,000/- in favour of the petitioner which got bounced due to insufficient fund.
It is submitted by the learned counsel for the petitioner that the cheque was given by way of sureties. Though, no actual loan amount of Rs. 1,50,000/- was given to the informant. However, petitioner is ready to deposit an amount of Rs. 1,05,000/- before the learned court below
Patna High Court Cr.Misc. No.31000 of 2015 (2) dt.31-07-2015 within a period of three months. It will be invested in some fixed deposit scheme in connection with the present case and the same will be subject to the final result of the case. Considering the aforesaid facts, let the above named petitioner be released on provisional anticipatory bail for three month in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga, in connection with Darbhanga P.S. Case No. 27 of 2014, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
The provisional bail of the petitioner will be confirmed by the learned court below on deposit of Rs. 1,05,000/-.
