JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 16-05-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Dumariaghat P.S. Case No. 05 of 2016, registered under Section 414 of the Indian Penal Code.

The accusation is that on receiving secret information by the Police regarding carrying of theft oil tanker by a person, the Police reached at Dumariya ghat bridge and in that course a tanker bearing Reg. No. BR-0H-9564 was stopped then driver of the said vehicle started to flee away, but on chase, he was apprehended by the Police. On demand, no paper was produced by him regarding the oil tanker.

Learned counsel for the petitioner submits that, in

Patna High Court Cr.Misc. No.20666 of 2016 (2) dt.16-05-2016 2/2 fact, the petitioner who was pass stand has been apprehended by the Police mere on suspicion, who has no criminal antecedent and in custody since 19.01.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-1, East Champaran at Motihari in connection with Dumariaghat P.S. Case No. 05 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
