The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 448, 323, 307 and 506/34 of the Indian Penal Code.
It is alleged that the accused persons came to the house of the informant and assaulted his son when informant made protest he was also assaulted by the accused persons. Though the impugned order reflects lacerated injuries but the opinion for the same has been kept reserved.
It is submitted by learned counsel for the petitioner that for a petty dispute, the accusation has been levelled. Moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the same has
Patna High Court Cr.Misc. No.33350 of 2015 (2) dt.12-08-2015 2/2 been brought on record as annexure-2 to the petition. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
The aforesaid facts may constitute good ground for consideration of prayer for regular bail.
Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with NTPC P.S. Case No.15 of 2015, pending before the learned Judicial Magistrate, 1st Class, Bhagalpur.
With the above observation, this application is, accordingly, disposed off.
