The petitioner seeks bail in a case instituted under Section 30 ka/38(2), 41(1) Excise Act, 2016.
It is alleged that 150.8 litres of foreign wine is said to have been recovered from the vehicle of the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 02.06.2017. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Nothing is said to have been recovered from the possession of the petitioner. There is no compliance of section 100 of the Cr.P.C.
On behalf of the state, it has been submitted that the
Patna High Court Cr.Misc. No.30637 of 2017 (2) dt.07-07-2017 2/2 petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Court, Excise, Patna in connection with Danapur P.S. Case No. 329 of 2017.
