JUSTICE MOHIT KUMAR SHAH ORAL ORDER 07-12-2022 The present writ petition has been filed seeking the following relief:- "1. That this is an application for issuance of an appropriate writ, order, direction, for removing the encroachment from the pond situated at Gairmazarua Malik land bearing Khata No. 212, Khesra No. 2042/2220, Thana No. 821, Village-Harpur Bazar, DistrictGopalganj upon which the Respondents no. 5 and 6 have constructed pacca boundary wall due to which the water outlets from the pond as well as the proper channel of water to the villagers
Patna High Court CWJC No.16544 of 2022(2) dt.07-12-2022 2/2 have been obstructed and further to pass any other order or orders to which the petitioner is found entitled."
At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Uchkagaon, DistrictGopalganj for redressal of his aforesaid grievance. Liberty so sought is granted.
It is needless to state that in case the petitioner approaches the Circle Officer, Uchkagaon, District-Gopalganj by filing appropriate petition under the provisions of the Bihar Public Land Encroachment Act, 1956, within a period of four weeks from today, the same shall be considered, in accordance with law and after hearing the affected parties, appropriate orders shall be passed thereon, forthwith.
The writ petition stands disposed off on the aforesaid terms.
