JUSTICE SUDHIR SINGH ORAL ORDER 27-06-2016 Heard learned counsel for the petitioners and the State. The petitioners are apprehending their arrest in a case instituted under Sections 323, 386, 307/34 of the Indian Penal Code and 3 (i) (x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities ) Act.

Allegation against the petitioners is that they assaulted informant and called him by his caste name. They also snatched Rs.30,000/- from his pocket.

It is submitted on behalf of the petitioners that they have got no criminal antecedent. F.I.R. has been instituted under Section 156(3) of the Code of Criminal Procedure. Prior to institution of the present case, a case was instituted by father of the petitioners against the informant for the offence under Section 302 of the Indian Penal Code. To put pressure upon the petitioners and their families the present case has been instituted. There is no injury report to support the allegation made against the petitioners. No offence is made out under the provisions of SC and ST Act. On behalf of the State, it is submitted that petitioners are

Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of Sri Amrendra Kumar, learned Judicial Magistrate Ist Class, Jamui, in connection with Laxmipur P.S. Case no. 154 of 2015 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
