1. Heard learned counsel for the petitioner and learned APP for the State.
2. The petitioner apprehends his arrest in connection with Patrakar Nagar P.S. Case no.35 of 2025 registered under sections 191(2), 191(3), 190, 223 of B.N.S, 2023.
3. The allegations in the F.I.R is that 15-20 young boys took out motorcycle procession in which one of them resorted to blank firing and the said video went viral.
4. Learned counsel for the petitioner submits that F.I.R was lodged against 15-20 unknown persons. So far as this petitioner is concerned, he has been made an accused in this case only on account of he being identified in the video two days after the occurrence, although the petitioner was not a part of the said procession. Learned counsel for the petitioner further submits that petitioner is aged about 40 years whereas the

It is further submitted that even as per the video, no specific overt act has been alleged against the petitioner. Learned counsel for the petitioner further submits that similarly situated co-accused has already been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 10.09.2025 passed in Cr. Misc. No. 60643 of 2025. The petitioner undertakes to co-operate in the case/trial.
5. The application for anticipatory bail is opposed by learned A.P.P. for the State.
6. Taking into consideration the aforesaid facts and circumstances of the case and also considering that there is vague allegation against this petitioner, no specific overt act having been imputed upon him and similarly situated coaccused has been granted bail by aforesaid order dated 10.09.2025 and case of the petitioner stands on better footing, it is directed that the petitioner, above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Patrakar Nagar P.S. Case no.35 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with
Patna High Court CR. MISC. No.68552 of 2025(2) dt.26-09-2025 3/3 two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/Successor Court, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
