The petitioner apprehends his arrest in connection with Jokihat P.S. Case No. 274 of 2016 registered for the offences punishable under Sections 147, 148, 149, 452, 341, 323, 307, 354 (B), 380, 427, 436, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
In the fardbeyan, lodged by Binod Kumar Das, against the petitioner there is no allegation for committing any overt act. Submission is of false implication and that in this case, co-accused Anil Bishwas, Ranjeet Chaudhary, Mahesh Chaudhary, Babloo Chaudhary, Santosh Chaudhary, Pawan Kumar Mandal and Pankaj Kumar have already been allowed prearrest bail vide Cr. Misc. No. 23044 of 2017 by another co-
Patna High Court Cr.Misc. No.31146 of 2017 (3) dt.19-08-2017 ordinate Bench of this Court and the case of the petitioner stands on better footing. The petitioner has no criminal antecedent. Learned APP fairly submits that other co-accused have been allowed pre-arrest bail.
In the facts and circumstances stated above, the petitioner above named, in case of his arrest or surrender within a period of four weeks from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. II, Araria in connection with Jokihat P.S. Case No. 274 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Jitendra Mohan Sharma, J) avin/- U T
