JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-08-2017 The petitioner seeks regular bail in connection with Bhargama P.S. Case No. 24 of 2017, registered for offences punishable under Sections 302, 201/34 of Indian Penal Code. Allegation against the petitioner and accused persons is of killing the son of the informant.

It has been submitted on behalf of the petitioner that save and except suspicion that the petitioner has taken the deceased with himself and, thereafter, the dead body of the deceased was recovered, there is nothing against the petitioner so as to show his involvement in the present case. Further petitioner has no criminal antecedent and has been in judicial custody since 11.02.2017. Learned counsel for the State opposed the prayer for bail and submitted that petitioner is the person, who took the deceased

Patna High Court Cr.Misc. No.33735 of 2017 (3) dt.07-08-2017 with himself and, thereafter, his dead body was recovered and also there was motive behind the occurrence as the deceased and sister of the petitioner had affair, for that the deceased was also threatened earlier.

Having heard both sides, considering the fact and circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the trial court is directed to expedite the trial and try to conclude it as early as possible.
