The petitioner in the present case is seeking regular bail in connection with Baruraj P.S. Case No.314 of 2018 registered for the offence punishable under Sections 302 and 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case due to previous enmity. Learned counsel submits that the petitioner has committed no offence as alleged in the FIR. Learned APP has opposed the prayer for bail.

Considering the facts and circumstances of the case wherein there is a direct allegation of giving knife blow is against this petitioner and the same has been corroborated by the

Patna High Court CR. MISC. No.62484 of 2019(3) dt.03-12-2019 2/2 postmortem report of the deceased mentioned at paragraph 38 of the case diary, this Court is not inclined to grant regular bail to the petitioner at this stage. This application is dismissed. Let the trial be expedited.
