JUSTICE ARUN KUMAR ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the learned APP appearing on behalf of the State. Petitioner apprehends his arrest in connection with Begusarai (Muffasil) P.S. Case No.260 of 2015 registered under Sections 372, 364, 365, 368/34 and 120(B) of the Indian Penal Code.

Allegation is that the accused persons including the petitioner enticed away wife of the informant for indulging her in flesh trade.

Learned counsel for the petitioner submits that the informant is not the eye-witness. It is not referred in the First Information Report that who had taken away the wife of the informant in fact the wife of the informant was of unsound mind and left the home. This petitioner has falsely been implicated in this

No.30532 of 2017 (2) dt.07-07-2017 2 / 2 case, this case is lodged after lapse of three months of the alleged occurrence without any explanation and similarly situated accused persons, namely, Anjani Devi and Vikash Tanti have been granted anticipatory bail by coordinate Benches of this Court vide order dated 16.03.2017, passed in Cr. Misc. No.36342 of 2016 and 17.09.2016, passed in Cr. Misc. No.27727 of 2016. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Begusarai (Muffasil) P.S. Case No.260 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
