This is the second attempt of the petitioner to seek bail as earlier his bail application was rejected by order dated 09.02.2022 in Cr. Misc. No. 52320 of 2021 as it was a case under Section 302 of the Indian Penal Code and the petitioner is husband of the deceased.
Learned counsel for the petitioner submits that all the non-official witnesses have been examined and only Investigating Officer and Doctor remain to be examined as a result of which the trial is being delayed on account of their non-appearance.
The District Magistrate, Begusarai and Superintendent of Police, Begusarai are directed to ensure that the Doctor and
Patna High Court CR. MISC. No.61918 of 2022(2) dt.23-11-2022 2/2 the Investigating Officer appear in the trial failing which appropriate and strict legal action be taken against the official witnesses if they don't appear before the learned trial court on the next day. If the Investigating Officer and the Doctor have already appeared, then the present order is to be ignored. The Court presently is not inclined to release the petitioner on bail. His prayer for bail is thus rejected. Let this order be sent to the District Magistrate, Begusarai and Superintendent of Police, Begusarai for its strict compliance (Satyavrat Verma, J) Rishi/- U T
